Judgment
Heard both sides.
The prayer in the writ petition is to direct the Respondents No.1 to 3 to provide the adequate Police Protection for the peaceful conduct of the Aadhikalathu Sri Kalyana Vinayagar Kovil's “Vinayagar Chathurthi” temple festival and Annathanam scheduled to be held on 14.09.2026 at Mammaanipatti, Boothamangalam Village, Melur Taluk, Madurai District based on petitioner's representations dated 19.08.2026 and 22.08.2026.
The petitioner claims that he is a poojari of the said temple and he has decided to conduct “Vinayagar Chathurthi” on 14.09.2026 and therefore he sought for police protection by his representations dated 19.08.2026 and 22.08.2026 which are pending consideration and in the mean time this Writ petition has been filed.
The learned Government Advocate (Criminal Side) submitted that the representation of the petitioner has been received by the Inspector of Police, Keelavalavu Police Station, Madurai District only on 24.08.2026.
The learned Government Advocate (Criminal Side) submitted that the petitioner's representation was received only on 24.08.2026 and it is under consideration either to grant permission for police protection or not.
At this juncture, Mr. Sarathkumar, Advocate of this Court, intervened and submitted that there is a rival party in the village, Mammaanipatti. Therefore, he is proposed to file intervening application in this case. It is learned from the submission of Mr. Sarathkumar, Advocate, that there is a rival party in the village not allowing the petitioner who is a poojari to go ahead with the Vinayagar Chathurthi festival when it was put the petitioner's counsel and he stated that the village people have no role, in conducting Vinayagar Chathurthi and it is the customary practice that the poojari has to celebrate Vinayagar Chathurthi by Annathanam. In turn, the Government Counsel submitted that the petitioner is having no money perform the services and the petitioner could not be able to give Annathanam for more than 1000 people and there is something to be enquired.
Recording the above submission, it is left open to the third respondent first to decide the petitioner's request after examining the petitioner as well as the rival party and take a better decision to allow the petitioner or the rival party or both jointly to conduct the Vinayagar Chathurthi on 14.09.2026 and provide police protection.
The learned Counsel for the petitioner as well as the intervening Advocate are requested to inform this order to their respective clients to appear before the respondent police on 03.09.2026 at 11.a.m. and said that the third respondent has to enquire and take a better decision within four days which enable the parties to proceed further to celebrate the Vinayagar Chathurthi. The learned Government Advocate is requested to inform the order of this Court to the third respondent over a phone and proceed further.
With the above directions, this writ petition stands disposed of.
