The OA No. 1524/2019 was decided vide directions dated 19.08.2019. The applicant preferred CP No.540/2019 alleging non compliance. Notice was issued on 13.12.2019 and it was to be listed on 24.03.2020. However, by that time, the Covid-19 restrictions came into place.
Thereafter, the applicant preferred another CP No.142/2020, alleging further and fresh defiance of the directions of this Tribunal. It was alleged that a fresh cause of contempt has arisen because of the further extension of the suspension period for further 180 days, as was ordered w.e.f. 24.05.2020.
The applicant is represented by Ms. Rukhmini Bobde, learned counsel and Shri Gyanendra Singh, learned counsel represents for respondents.
The respondents pleaded that for the same direction two contempt petitions are not maintainable and they may be given two weeks time to submit their reply in the CP-540/2019. Leaned counsel for applicant pleaded that they are willing to withdraw the CP No.142/2020.
The matter has been heard.
In view of the objections raised by the learned counsel for respondents, the learned counsel for petitioner seeks permission to withdraw the CP No.142/2020, with a further prayer that the contentions made in the second CP may be read and referred as part and parcel of the first CP.
In view of the prayer of the applicant, the second CP No.142/2020 and the Annexures thereto, shall be read and referred as part and parcel of the first Contempt Petition No.540/2019.
The CP-142/2020, under this number, stands dismissed as withdrawn.
