This Writ Petition is filed seeking the following relief:-

“Therefore, it is prayed that this Hon’ble Court may be pleased to issue an order, direction more particularly one in the nature of writ of Mandamus declaring the notice R.C.B.8/2022, dt. 21.09.2022 issued by the Tahsildar, Venkatagiri Mandal, Tirupati District, the 3rd respondent herein u/s. 7 of the A.P.Land Encroachment Act, 1905 as illegal, arbitrary, issued for extraneous considerations and also violative of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondents not to interfere with the possession and enjoyment of the house situated in an extent of nearly 3 cents of land in Sy.Nos.202/3 of Ammavaripeta village and 164 of Periyavaram revenue village, bounded by North: the remaining land in Sy.No.202 of Ammavaripeta, East: Cheruvu katta, South: Railway Station Road and West: Road in Periyavaram village, Venkatagiri Mandal, Tirupati District and pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.”

Heard Sri V.Santhisree, learned counsel for the petitioner as well as learned Government Pleader for Revenue.

Questioning the show cause notice, dated 21.09.2022, issued by the respondent No.3 seeking eviction of the petitioner from the scheduled property, the present Writ Petition is filed.

Learned counsel for the petitioner fairly states that explanation to the impugned show cause notice has not been submitted by the petitioner.

In that view of the matter, the Writ Petition is disposed of permitting the petitioner to submit his explanation to the show cause notice within a period of two (02) weeks from today. On such explanation being received, the respondent No.3 is directed to pass appropriate orders within a period of two (2) weeks thereafter, after giving opportunity to the petitioner. Till such time, both the parties are directed to maintain status-quo. No costs.

Pending miscellaneous applications, if any pending, shall stand closed.
