Antony Dominic, J.—Petitioner applied to the University for the issuance of a certificate to the effect that the B. Sc Degree in Plant Biology and Bio Technology that she has acquired from Bharathiyar University, is recognised for higher studies. It is stated that such certificates are being issued by the University of Calicut. Exts.P3 and P4 are referred to by the Petitioner in support of this plea. It is stated that the application was considered by the first Respondent University pursuant to the directions in Ext.P5 judgment and Ext.P6 memo has been issued conveying that the academic bodies of the University considered the request of the Petitioner and resolved not to recognise the degree as equivalent to B. Sc degree in Bio Technology of the University of Calicut. According to the Petitioner, the request made is not to recognise the degree but on the other hand, to recognise the University for eligibility purposes.

Standing Counsel appearing for the University brought to my notice the provisions contained u/s 38 of the Kerala University Act, 1974. It is stated that the request such as the one made by the Petitioner is to be dealt with in accordance with Section 38(e) which confers power on the Academic Council to make regulations for recognisation of degrees and diplomas of other University. It is stated that it was in pursuance to the said power, regulations have been framed and it is consistent with such power, the request of the Petitioner was considered.

Evidently therefore, the Respondents can only consider the degree obtained by the Petitioner from another university only as per the Regulations framed in pursuance to Section 38(e) of the Act. The request of the Petitioner has been considered consistent with such power and the academic body of the university has rejected the same. There is no provision for the issuance of a certificate similar to Exts.P3 and P4. If that be so, the view taken by the university in Ext.P6 cannot be faulted.

Writ petition is only to be dismissed and I do so.
