W.P.No.13360 of 2019 is filed by the petitioner-school seeking a Mandamus/direction to the respondents to consider their representation with regard to the gas godown established by the 8th respondent. They have raised certain objections to the establishment and the continuation of the said gas godown and submitted a representation which has yet to be considered by the authorities/official respondents. This writ petition was filed in the year 2019 and it is still pending.
In view of the delay, W.P.No.12686 of 2021 was filed by the petitioner (8th respondent in the earlier writ petition i.e. W.P.No.13360 of 2019) seeking a Mandamus to issue the requisite licence form-B etc., for establishing petrol bunk.
Sri A.K.Kishore Reddy, learned counsel for the petitioner in W.P.No.12686 of 2021 points out that in para 8 of the counter affidavit the Joint Collector has taken the plea that they could not process the case because of the pendency of W.P.No.13360 of 2019. This was also communicated to the petitioners by their letter dated 25.02.2020.
This Court is not going into the merits of the issue. The respondents who are the statutory authorities have to decide the issue. The mere pendency of W.P.No.13360 of 2019 cannot be a cause for this delay.
Without saying anything further on the merits of the matter, both the writ petitions are disposed of with a direction to the 3rd respondent to consider the representation made by the petitioners in W.P.No.13360 of 2019 and also the eligibility of the petitioner in W.P.No.12686 of 2021 and pass a speaking order on the matter within a period of four (4) weeks from the date of receipt of a copy of this order. If any party so desires, they should be given an opportunity of personal hearing and an opportunity to file necessary documents in support of their contentions. The time schedule fixed should however be strictly adhered to. Neither party shall seek adjournment in this matter. Needless to say the orders must be passed on its own merits and as per law. No order as to costs.
As a sequel, the miscellaneous petitions if any shall stand dismissed.
