Heard learned advocate Mr.Shivang Shukla appearing on behalf of learned advocate Ms.Srushti Thula for the petitioner and learned advocate Mr.Siddharth Dave for the respondent - Authority.
Learned advocate Mr.Shukla has grievance that inspite of the fact that the petitioner has preferred appeal before the NCTE Appellate Committee in the year 2019, the same is not heard till date and the petitioner - College would loose one more year if the appeal is not decided at the earliest.
In view of the above statement made by the learned advocate for the petitioner, on 21st September, 2021, following order was passed :
"1. Heard learned Advocate Mr.Siddharth Dave for the Respondent - Authority.
Learned advocate Mr.Dave prays for when the appeal filed by the petitioner disposed of by the Respondent-Authority. 3. Stand over to 23rd September, 2021." time to take instructions as to in the year 2019 shall be finally Today, when the matter is called out, learned advocate Mr.Dave submitted that he could not get any instructions from the respondent - Authority.
Thereafter, the matter was kept in the second half to take instructions from the Appellate Committee that who are the appellate members who can hear the appeal of the petitioner. Learned advocate Mr.Dave has submitted that following two persons are the members of the Appellate Committee who are going to hear the appeal : (1) Mr.Pritam Singh, Deputy Secretary, NCTE, and (2) Mr.R.C. Chopra, Section Officer, NCTE.
Registry to issue Notice to both the above persons to remain personally present on 27th September, 2021 before this Court at 11.00 a.m. Copy of this order to be given to Mr.Dave so that the same can be forwarded forthwith to both the officers, so as to seek explanation as to why, the appeal, which is pending since 2019, is not heard.
Stand over to 27th September, 2021.
