The applicant states that he is working as a Guest Teacher in the Department of Education, Govt. of NCT of Delhi. The appointment is subject to

the condition that the persons, so appointed, would be replaced as and when the regular selection and appointment takes place.

The applicant contends that the respondents are not following the principle of “last come first go†in the context of replacing the Guest

Teachers, as and when regular candidates are appointed.

We heard Mr. Anuj Aggarwal, learned counsel for the applicant and Ms. Esha Mazumdar, learned counsel for the respondents, at the stage of

admission.

Even according to the applicant, he is now continuing as a Guest Teacher. In the OA, it is stated that the Government has framed a policy, to be

followed in the context of replacement of Guest Teachers, with the regular teachers. It is only when the guidelines are violated or the applicant is

discontinued, contrary to any settled principles of law, that he can approach the Tribunal.

The present OA is filed on mere apprehension. It is fairly well settled that no relief can be granted on the basis of mere apprehension. The OA is

accordingly dismissed. It is, however, left open to the applicant to approach the Tribunal, in case he faces any adverse orders or steps from the

respondents.

There shall be no order as to costs.
