Judgment

The applicants who commenced their service as GDS in 1979 and were appointed as MTS years thereafter, have approached this Tribunal to reckon their service as GDS for the purpose of pension and pensionary benefits.
When the matter was taken up, learned SCGSC placed before us the decision of Hon'ble Supreme court in Union of India and others v Gandiba Behera [(2019) SCC Online SC 1444] which had been followed by a Division Bench of Hon'ble High Court of Kerala in OP(CAT) No.166 of 2020. It has been affirmed that the service as GDS rendered in the Postal Department cannot be reckoned for any purpose including pension.
Having heard learned Counsel for the applicant and the learned SCGSC, we are inclined to follow the same decision, holding that the relief sought in the O.A cannot be granted.
The O.A fails and is dismissed. No costs.
