Judgment

This petition has been heard through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic.
By order dated 17.08.2021, time was allowed for removing the defects.
I.A. No. 4807 of 2021 has been filed on behalf of the petitioner wherein para 4 it has been stated as under:-
"4. Pursuant to this Hon'ble Court's direction in order dated 17th August, 2021, the petitioner on 18th August, 2021 filed an application before the learned Trial Court seeking supply of the certified copy of the Complaint along with annexures and Relied Upon Documents ("RUDs") as filed by the respondent, for the purpose of filing the same before this Hon'ble Court in accordance with directions. Upon doing so much to the utter shock of the petitioner, the petitioner found that none of the documents or statements relied upon by the respondent in the complaint, were available on the record of the learned Trial Court."
Mr. Sidharth Luthra, learned senior counsel appearing on behalf of the petitioner submits that in view of above statements and remark at page 20 of the said interlocutory application, the petitioner has not been able to remove the defects as documents which are said to be annexed with the complaint, has not been supplied to the petitioner.
In that view of the matter, the surviving defects are ignored for the time being.
On asked by the Court whether he wants to respond the said I.A. or not, Mr. A.K. Das, learned counsel for the E.D. submits that he wants to respond the said interlocutory application for which a week's time is required.
Time, as prayed for is allowed.
The aforesaid I.A. shall be considered at the time of admission.
Let this matter appear on 22.09.2021 under the heading for admission.
Interim order dated 05.08.2021 shall remain in force till the next date.
