Soumen Sen, C.J.

Heard Mr. R. Krishna Raj, learned counsel for the petitioner.

2.

The petitioner is the landlord. This petition has been filed for expeditious disposal of the rent control petition filed by the petitioner before the Rent Control Court, Karunagappally, as RC(OP) No. 4 of 2022. The grievance of the petitioner is that the respondents are in possession of the commercial building, which is situated on the side of the National Highway, without paying any rent since September 2021, and that the Rent Control Court is not taking appropriate steps to dispose of the rent control petition, thereby enabling the petitioner to recover possession of the property.

3.

The petitioner has disclosed the case history in RC(OP) No. 4 of 2022 pending before the learned Rent Control Court. It appears from the case history that the matter was posted on 19th March 2026 to consider I.A. Nos. 2 of 2025 and 1 of 2026. It further appears that, on 28th March 2026, the respondents-tenants prayed for the hearing of I.A. No. 1 of 2026, and the matter was fixed for orders in I.A. No. 2 of 2025. It appears that, from time to time, various applications have been filed in the proceedings, and the said applications are presently under adjudication. It cannot be said that the respondents did not participate in the proceedings or were not diligent.

4.

Considering the fact that a few applications are still pending in the main rent control petition, we dispose of this matter by directing the Munsiff Court, Karunagappally, to dispose of the pending applications as expeditiously as possible, preferably within a period of three months from the date of communication of this order, subject to the convenience of the court, and also to make an endeavour to dispose of the rent control petition in accordance with law, without granting any adjournment to either party unless it is unavoidable.

5.

The petition is accordingly disposed of. In view of the nature of this order, no notice is required to be served on the respondents. However, a copy of this order shall be communicated to the respondents.
