Judgment
The applicant had filed this OA, seeking the following reliefs:-
"(A) Allow this OA of this applicant and declare that this applicant shall be entitled to receive and use her 50% shares separately as admitted in MTNL letter dated 07.11.2016 towards Family Pension, DCRG, Final Payment of GPF and GSLIS of her husband late Deepchand Ram (MZ-18783) who expired on 01.03.2015 based on the papers of applicant submitted to MTNL on 17.10.2016 as per MTNL‟s letter dated 03.10.2016.
(B) Consequently direct the MTNL not to withheld nor delay payment to her separately, 50% dues towards Family Pension, DCRG, Final payment of GPF balance, GSLIS etc. as per her submitted papers on 17.10.2016, without being affected by the inaction of Rambachan another legal heirs entitled for 50% shares, within a reasonable period of time.
(C) Consequently, direct the MTNL to act further and complete all further formalities and approval post 07.11.2016 onwards and release separate 50% shares of Family Pension, DCRG, Final payment of GPF, GSLIS etc. to this applicant without any further delay in the matter else held the MTNL liable for making reasonable amount of interest to the applicant on the interest of justice.
(D) Pass any such other/further consequential order(s)/direction(s) which this Learned Tribunal deems fit and proper in the facts and circumstances of the present case."
Counsel for both the parties are present. Counsel for the applicant states, on instructions from the applicant, that she has received all the amounts she had asked for in this OA and hence nothing remains to be decided. Accordingly, the OA is treated as disposed off. No order as to costs.
