Judgment
Petitioner Smt. Anjali Ghosh was respondent No.1 in MAC App. No. 51 of 2018 before this court. She was awarded Rs.14,26,500/- by this court vide order dated 28.11.2019. The amount after adjustment with the deposits made by the insurer at the tribunal is lying in the UCO bank in its District Court branch.
Said Smt. Anjali Ghosh has filed a petition before this court seeking withdrawal of the amount on the ground that she will need money for her medical treatment outside the State. Smt. Ghosh has sworn an affidavit in support her contention.
Heard Mr. T.D. Majumder, learned senior advocate appearing for the petitioner.
Considering the ground on which the withdrawal is sought for and the documents annexed in support of her contention, applicant is allowed to withdraw an amount of Rs.5,00,000/- (Five lakhs) from her said fixed deposit.
The Motor Accident Claims Tribunal (Court No.2), West Tripura, Agartala will disburse Rs.5,00,000/- from the said fixed deposit of the applicant and rest of the amount along with interest accrued thereon shall be re-invested in a fixed deposit in the name of the petitioner for the remaining period i.e. till 2nd June, 2025.
Send a copy of this order to the Motor Accident Claims Tribunal (Court No.2), West Tripura, Agartala for compliance.
Also provide a copy of this order free of cost to learned counsel of the petitioner.
In terms of the above, the petition is disposed of.
