Judgment
Through the medium of the instant petition, the petitioners-Union Territory of J&K are seeking quashment of impugned judgment and award dated 19.05.2025 passed by the One Man Forest Authority, District and Sessions Judge, Srinagar in case tilted “Ghulam Hassan Lone (Deceased) Through legal heir Waseem Hassan Lone vs State of Jammu & Kashmir and Ors” bearing File No. 34 of 2019.
Mr. Mohsin S. Qadri, learned Senior Additional Advocate General appearing on behalf of petitioners at the very outset, placed reliance upon an order dated 12.08.2025 passed by a Coordinate Bench of this Court in case titled as “Union Territory of J&K and Others. Vs M/S Ghulam Nabi Sumji through its Managing Partner” being RFA No. 58/2025 and submits that the case of the petitioners herein is identical to the case of petitioners as set up in the said writ petition and prays that same order be also passed in the instant writ petition as well.
With a view to maintain parity, this Court deems it appropriate to pass same order as has been passed by Coordinate Bench of this in the aforesaid writ petition.
Heard learned counsel for the petitioners at length and perused the material on record.
Issue notice to the respondent(s) in the main petition as well as in the connected CM, returnable within a period of four weeks.
Requisite steps for service within one week.
List on 25.11.2026.
In the meantime, subject to objections from the other side and till the next date of hearing before the Bench, the operation of impugned judgment and award dated 19.05.2025 passed by the One-Man Forest Authority, District and Sessions Judge, Srinagar in case tilted ““Ghulam Hassan Lone (Deceased) Through legal heir Waseem Hassan Lone vs State of Jammu & Kashmir and Ors” bearing File No. 34 of 2019., shall stay.
Modification/Vacation/Alteration on motion.
Learned counsel for the petitioners is directed to provide the list of similar matters to the Registry during the course of the next week, and subject to providing the list of identical matters, the Registry shall club all those matters and list them along with this case, treating this case as the lead case.
