By Hon’ble Mr. Mohan Pyare, Member (Administrative) :

The present Delay Condonation Application No.4589 of 2026 in Review Application has been placed before me under circulation in terms of Rule 17(3) of the Central Administrative Tribunal (Procedure) Rules 1987. The review applicants seeks condonation of delay in filing the review application against the order dated 18.05.2026 passed in OA No.511 of 2022, in which the OA was allowed. Civil Misc. Delay Condonation Application No.4589 of 2026 was filed along with Review Application on 27.08.2026.

2.

In the review petition, learned counsel for the respondents has submitted that delay in filing the review petition is neither intentional nor deliberate but was occasioned for the reason as mentioned in this application as such the delay in filing the Review Application be condoned. He has further submitted that the reason of delay as shown above is bonafide in law and the same deserves to be condoned in the interest of justice. The order of the OA was pronounced on 18.05.2026 and the present review petition has been filed on 27.08.2026. Learned counsel for the respondents has not submitted any authority to support his claim that delay in filing the review petition due to long administrative process is condonable.

3.

Rule 17(1) of CAT (Procedure) Rules, 1987 is reproduced as under:-

“ No application for review shall be entertained unless it is filed within 30 days from the date of receipt of copy of the order sought to be reviewed.”

4.

In the case of Union of India & ors. Vs. Shailendra Kumar Verma in Writ-A No.18842 of 2025, the Hon’ble High Court of Judicature at Allahabad has observed that Tribunal can condone the delay under Section 5 of the limitation Act, if it is satisfied that sufficient cause for non prefering an application within the time has been supplemented with proper explanation.

5.

I have carefully gone through the case laws referred hereinabove, as discussed in para 03 and 04 above and find that the reason shown by learned counsel for the respondetns appears to be sufficient to get the benefit of law laid down by Hon’ble High Court of Allahabad in Writ –A No.18842 of 2025 to review the order of this Tribunal. In this matter, the review application has been filed on 27.08.2026 whereas judgment/order was pronouced on 18.05.2026 itself and the review application is filed beyond the limitation period by few days. The delay condonatiion application in filing the review applicaton is hereby allowed. Delay occurred in filing the review application is hereby condoned treating the review application filed within the limitation period.

6.

I have also carefully gone through the ground taken to review the judgment/order passing the OA. Although, the issue raised/pleaded have been dealt with, the review applicants intent to re-open the issue through review application afresh, which cannot be permitted. Thus, ground taken to review the judgment/order passed in the OA are not sufficient. Accordingly, the review application is rejected.
