Judgment

S.A. NO.167 OF 1996 & MISC. CASE NOS.166, 167 AND 168 OF 2010
This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
As per noting of the Registry, direction was given to the appellant for issuance notice in Misc. Case Nos.166, 167 and 168 of 2010. But, the notice on PLR No.4(c) has not been made sufficient, because, he is abiding to receive the same.
The appellant is interested to serve notice on the PLR No.4(c) through Special Messenger.
Therefore, the above prayer of the learned counsel for the appellant is allowed.
The appellant is allowed to serve notice on the PLR No.4(c) through Special Messenger at the cost of the appellant. Therefore, the Registry is directed to assess the cost and allow the appellant to deposit the same within three working days and the notice be issued thereafter through Special Messenger fixing a short returnable date.
It is submitted by learned counsel for the appellant that, the year of the Misc. Case Nos.166, 167 and 168 has been written as “2012” instead of “2010” in the cause list due to typographical errors. The same may kindly be corrected.
On consent of the learned counsels of both the sides the Misc. Case Nos. 166, 167 and 168 of 2012 be read as Misc. Case Nos.166, 167 and 168 of 2010. The Registry is to take note of this fact.
