O.A. is at notice stage hearing. Having received advance copy of O.A., Shri P.K. Mishra has appeared for respondents. Matter relates to compassionate appointment. Heard.

Applicant is claiming that his appointment for compassionate ground is lying pending decision since long and the respondents are not taking any final decision and time and again are raising query. That now vide letter dated 06.11.2020 Assistant Director (Rectt.) observing that as per certificate given by Circle Officer, Belaganj dated 13.06.2016, the deceased employee was having no land and SSPOs, Gaya gave the report that the family is living in their own house and that it has been decided therefore to get the facts re-verified and on receipt of the report, the case shall be considered in the CRC. That copy of aforesaid letter has been endorsed to the SSPOs, Gaya with endorsement:- “Copy to The SSPO’s, Gaya Dn. Gaya w.r.t. your letter no.B2-1/Relax/Umanath Bhadani dated 07.01.2020. Kindly find enclosed here with a copy of land possession certificate dated 21.02.2011, a copy of circle officer, Belaganj certificate letter no.97/dated 13.06.2016 and a copy of Synopsis Part-I. It is requested to verify the matter from the circle office and submit your detailed report as early as possible.” That another copy of said letter has been forwarded to Assistant Director (LC) with endorsement “The Assistant Director (LC), Circle Office, Patna w.r.t. letter no.LC/CAT-118/Gaya/2017 dated 08.05.2019. He is requested to intimate the CAT accordingly.” That still awaiting report his case is pending with respondent No.2.

Learned counsel Shri J.K. Karn Advocate submits that respondents may be directed to consider and decide the case of applicant for appointment on compassionate ground at the earliest in terms of policy available at the relevant period without raising unnecessary query. He requests to dispose of the O.A. by giving necessary direction to the respondents regarding this letter dated 06.11.2020 (Annexure – A/1).

Learned counsel for respondents submits that he may be able to clarify his case only after obtaining instruction or through written statement, if is directed to file.

Considered the submission. Taking note of entirety, we deem it fit and proper to dispose of this O.A. at this stage itself directing the SSPOs, Gaya Division, Gaya and the Assistant Director (Recruit), who are respondents No. 3 & 4, to work in synch, report as requisite, if is necessary, must be collected within a month. Respondents are directed to ensure that final decision about appointment on compassionate ground of the applicant be taken at the earliest possible.
