Judgment
Heard Sri. Harish Ganapathy, the learned counsel for the petitioner and Sri.K.Nageshwarappa, learned HCGP for the respondent.
The respondent-Police registered a case against the petitioner (Accused No.2) and two others in respect of offences punishable under Section 143, 147, 148, 307, 149 of Indian Penal Code, 1860 dated 21.11.2016 in their Crime No.0256/2016.
The allegation is that the accused persons armed with bear bottle, talawar and iron rod barged into the Bar and Restaurant, where the injured-Sandeep was employed and assaulted him with an intention to finish him off. The injured was hospitalized for two days. Subsequently, as per the statement of the injured, the petitioner is said to have assaulted him with a glass bottle. During the spot mahazar, broken glass pieces were seized by the Investigation Officer.
The learned counsel for the petitioner submits that the petitioner is ready to comply any condition that may be imposed by this court in the event of granting Anticipatory Bail. As per the Wound Certificate, the injured suffered one grievous injury on his right forehead and three simple injuries. Having regard to the facts and circumstances, there is no impediment to allow the petition.
Accordingly, the petition is allowed. The petitioner is granted Anticipatory Bail in Crime No.0256/2016 registered by the respondent police on the following conditions:
He shall forthwith appear before the respondent-I.O. The I.O. is at liberty to interrogate him. In the event of his arrest, he shall be released on bail on executing self bond for a sum of Rs.50,000/- with one surety for the likesum. Till filing of the charge sheet, he shall mark his attendance before the Station House Officer of the respondent-police station during the office hours of every Tuesday and Friday.
He shall maintain himself as a law abiding citizen and shall not approach/threaten the injured or the complainant.
