Judgment
Heard the learned counsel for the petitioner. Learned High Court Government Pleader takes notice for the respondent.
The petitioner (Accused No.1) is charge sheeted by the respondent police in respect of the offence punishable under Sections 143, 147, 148, 323, 307, 448, 427 and 120(B) R/w 149 of IPC in their Crime No.15/2017. The allegation is that along with the co- accused, the petitioner assaulted the husband of the complainant with deadly weapons, thus attempted to take away his life. They also barged into the house of the complainant and damaged the household articles. As per the wound certificate, the victim had suffered simple injuries. The co-accused are enlarged on bail by the order of this Court in Crl.P.No.1866/2017. Since the investigation is complete, there is no impediment to allow the petition.
Accordingly, the petition is allowed. The petitioner is enlarged on bail in Crime No.15/2017 of respondent-police, subject to the following conditions:
(1) He shall execute a self bond for a sum of Rs.50,000/- each with one surety for the likesum to the satisfaction of the concerned Court.
(2) He shall attend the Court regularly on all hearing dates.
(3) He shall not approach/threaten the complainant and the prosecution witnesses either directly or telephonically.
