I.A. No. 2547 of 2011
Learned Counsel appearing for the Petitioner submits that the Petitioner had initially challenged the order dated 18.5.2010 under which Respondent No. 3, Ajit Kumar Singh, the then Deputy Chief Inspector of Factories, Jamshedpur had been made In-charge, Chief Inspector of Factories, Jharkhand but during the pendency of this writ application he got retired and therefore, prayer has been made in the Interlocutory application bearing No. 2547 of 2011 to allow the Petitioner to delete the name of Ajit Kumar Singh from the memo of petition and further to delete the prayer No. 1 made in the main writ application.
The prayer made in the interlocutory application is hereby allowed. Let the name of Respondent No. 3 be deleted from the memo of petition. At the same time prayer No. 1 made in the writ application is also deleted.
3 .Heard learned Counsel appearing for the Petitioner in the main writ application.
Leaned counsel appearing for the Petitioner submits that though the Petitioner was senior to Ajit Kumar Singh as per the seniority list as contained in Annexure 2, still Ajit Kumar Singh, Deputy Chief Inspector of Factories, Jamshedpur was made In-charge, Chief Inspector of Factories, Jharkhand, Ranchi, vide order dated 18.5.2010, though the Government had taken decision for recommending the name of the Petitioner to be appointed as In-charge, Chief Inspector of Factories, Jharkhand, Ranchi. Since Ajit Kumar Singh has now retired on his superannuation on 30.6.2011, the authority be directed to appoint the Petitioner as In-charge, Chief Inspector of Factories, Jharkhand, Ranchi, as there has already been recommendation for appointing the Petitioner as In-charge, Chief Inspector of Factories, Jharklhand.
In view of the facts and circumstances stated above, this writ application is disposed of directing the Commissioner-cum-Secretary, Labour, Employment and Training Department, Government of Jharkhand, Ranchi, Respondent No. 2 to consider the case of the Petitioner for appointment as In-charge, Chief Inspector of Factories, Jharkhand, Ranchi within a period of six weeks from the date of receipt/production of a copy of this order.
