Judgment
These matters (M.A.T. 240 of 2020 and C.A.N. 1311 of 2020 and C.A.N. 1312 of 2020 taken out in the appeal) were assigned before us on March 16, 2020. They have appeared before us today on grounds of extreme urgency for which reason we have taken them up today.
The application filed on behalf of the appellant seeking leave to rely on additional evidence (C.A.N. 1312 of 2020) is not opposed by Mr. Bhattacharya, learned senior advocate for the respondent no. 1/writ petitioner.
Such application stands allowed.
We are informed by Mr. Bhattacharya that all the materials that were placed before the learned Judge in course of hearing of the writ petition have been made available to us. He prays for early hearing of the appeal having regard to the fact that the respondent no. 1/writ petitioner is in permanent service in the United Kingdom and has to join there immediately.
Since the appellant is not represented by its learned advocates today (for whatever reason), but is represented by its officers, we would wish an even contest and with that view in mind, we fix hearing of the appeal on Monday (23rd March, 2020). Put up the appeal on that date under the same heading.
In the event the appellant is not represented by its learned advocates, we shall proceed to hear the officers who are present before us today.
The interim order passed earlier stands re-imposed and shall continue till 27th March, 2020, if not directed otherwise, in the meanwhile.
