Judgment
Heard learned counsel for the Appellant. It is submitted that MA No. 32/CTB/2020 pending consideration before the Adjudicating Authority (National Company Law Tribunal) Cuttack Bench, Cuttack which was listed for hearing on 19th March, 2020 has not been heard subsequently on account of imposition of lockdown due to outbreak of COVID 19 pandemic. Learned counsel for the Appellant submits that despite Appellant's request for urgent listing of MA No. 32/CTB/2020, the same was not taken up for consideration.
Keeping in view the limited prayer, we dispose of this appeal by requesting the Adjudicating Authority (National Company Law Tribunal) Cuttack Bench, Cuttack to accord consideration to the aforesaid Miscellaneous Application after listing the same for hearing on a convenient date preferably within two weeks.
We make it clear that we are not expressing any opinion on the merits of the case.
A copy of this order be sent to the learned Adjudicating Authority (National Company Law Tribunal) Cuttack Bench, Cuttack for information and necessary action.
