Judgment
Aggrieved by the action of respondent No.4 in issuing the order dated 08.02.2023, and seeking to direct him to appoint the petitioner to the post of Junior Assistant in respondent No.4-Hospital, the present writ petition is filed.
The case of the petitioner is that his mother, late Dasari Blandina, was an employee of respondent No.4 Hospital, having been appointed as a Staff Nurse in the year 1985, and was subsequently, promoted as Head Nurse in 2011, and eventually, promoted as Nursing Superintendent Grade-II during November, 2020. However, the petitioner's mother died in harness on 20.05.2021, due the covid, leaving behind the petitioner, who was solely dependent upon her. The petitioner completed his Class-X from Telangana Open School Society in 2011 and Class-XII in 2017, and therefore, submitted his application dated 28.03.2022, seeking compassionate appointment. The petitioner also submitted relevant documents vide letter dated 18.05.2022 and a 'no earning member certificate/financial status certificate' vide letter dated 05.09.2022. Thereafter, on consideration of the said application, respondent No.4 issued the appointment order dated 03.12.2022. However, despite his eligible for the post of Junior Assistant, he was appointed as a Stretcher Bearer (LGS) on compassionate grounds, on the alleged ground that he did not possess the required qualification. Hence, the present writ petition.
Heard Sri Rajeshwar Indani, learned counsel appearing for the petitioner, and learned Government Pleader for Services-I, appearing on behalf of the respondents.
Learned counsel for the petitioner, primarily submits that during the pendency of the present writ petition, the petitioner had pursued and successfully completed his graduation in Bachelor of Arts in the year 2025. However, on instructions, it is also submitted that the petitioner is not pressing for the relief sought for in the present writ petition, and that he is willing to join duty in the post of Stretcher Bearer in pursuance of his appointment order dated 03.12.2022, and therefore, seeks indulgence of this Court to issue necessary directions.
Having regard to the above made submissions and in view of the fact that the petitioner himself is willing to join duty as a Stretcher Bearer, without going into merits of the case, the Writ Petition is disposed of permitted the petitioner to join duty as Stretcher Bearer in pursuance of his appointment order dated 03.12.2022, within a period of ten (10) days from the date of receipt of a copy of this order, and the respondents are directed to permit him to join duty accordingly.
Miscellaneous applications, if any, pending in this writ petition, shall stand closed. No costs.
