Judgment
This application is filed by the applicant seeking leave of the Court to permit the applicant herein to carry out substitute service on the respondent herein by way of publication in local daily newspaper.
Heard the learned counsel for the applicant.
On 20.06.2025, notice has been issued to the respondent. However, the same was returned with an endorsement 'returned unserved as the addressee left'. Subsequently, the whereabouts of respondent are not known.
Therefore, the instant application has been filed by the applicant seeking for service of notice through substitute service on the respondent herein by way of publication in local daily newspaper.
On due consideration, this Court is of the opinion that a strong case for allowing the instant application has been made out by the learned counsel for the applicant.
Accordingly, let notice in the present Arbitration Application be served to the respondent by substitute mode of service by way of publication in the daily newspaper having wide circulation in and around Hyderabad. Accordingly, let publication be made in one regional language as also in one English Daily Newspaper in this regard. Let publication be made in Telugu Newspaper, viz., Eenadu, Hyderabad Edition and so also in English Daily Newspaper, viz., Deccan Chronicle. Hyderabad Edition duly indicating the next date of hearing to the respondent for appearance in the matter.
Accordingly, the instant application stands allowed as above.
