Judgment

This writ petition is filed seeking the following reliefs:
“(i) Call for records leading to passing of Exhibit P-8 order dated 12.10.2022 in I.A. No. 176/2022 in O.P. No. 239/2018 of the 2nd respondent and quash Exhibit P-8 order by issuing a Writ of Certiorari or any other appropriate Writ, Order or Direction;
(ii) issue a Writ of Mandamus or any other appropriate Writ, Order of Direction, directing the Wakf Tribunal, Kozhikode to consider and dispose of Exhibit P-10 O.A. and Exhibit P-10(a) Stay Petition within a time frame fixed by this Hon'ble Court;
(iii) issue a Writ of Mandamus or any other appropriate Writ, Order of Direction, directing the 3rd respondent not to approve the plan and issue building permit for construction of Thalakkattoor Juma Masjid, pending consideration of Exhibits P-10 and P-10(a) by the Wakf Tribunal, Kozhikode.”
Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the 2nd respondent. In view of the directions being issued, notice to respondents 1 and 3 is dispensed with.
Learned counsel for the petitioner submits that as against Exhibt P8 order passed by the Waqf Board, the petitioner has preferred Exhibit P10 appeal along with a stay petition before the Waqf Tribunal.
This writ petition is, therefore, disposed of with a direction to the Tribunal to consider Exhibit P10 submitted by the petitioner as well as the stay petition, with notice to all concerned. Appropriate orders shall be passed within a period of two months from the date of receipt of a copy of this judgment. Further proceedings will be subject to the orders to be passed by the Tribunal.
