Judgment
The petitioners are Sunni believers. They approached this
Court by filing the captioned writ petition with the following prayers:-
"(i) Issue a writ of mandamus or any other appropriate writ order or direction commanding the 2nd respondent to pass final orders in Exhibit P-1 proceedings numbered as O.P.No.115/2011 within the time fixed by this Hon''ble Court,
(ii) Issue a writ of mandamus or any other appropriate writ order or direction commanding the respondents 3 to 5 to refrain from the inauguration of the reconstructed mosque, Chamal Mahal Juma Masjid, till the disposal of Exhibit P-1 petition by the 2nd respondent."
Chamal Mahal Juma Masjid was already inaugurated on 15.5.2017. In
such circumstances, the second prayer does not survive. It is obvious
that prayer No.1 is for issuance of a writ of mandamus commanding the
2nd respondent to pass final orders in Exhibit P-1 proceedings
(O.P.No.115/2011) within a time frame. The learned counsel appearing
for respondents 1 and 2 submitted that Ext.P1 could be disposed of within four months. We are of the view that recording the said
submission this writ petition can be disposed of. In such circumstances,
it is absolutely unnecessary to issue notice to respondents 3 to 5.
Hence, this writ petition is disposed of directing the second respondent
to dispose of Ext.P1 expeditiously at any rate, within a period of four
months from the date of receipt of a copy of this judgment.
