Heard Mr. G.C. Swain, learned counsel for the petitioner and Mr. P.K. Rout, learned counsel appearing for the opposite party.
The petitioner has filed this writ petition challenging the order dated 16.01.2013 under Annexure-1 passed by the Controlling Authority-cum-Assistant
Labour Commissioner, Jeypore in P.G. Case No.1 of 2012 under Section-7(4)(b) of the Payment of Gratuity Act, 1972.
Mr. P.K. Rout, learned counsel appearing for the opposite party contended that the order passed by the Controlling Authority-cum-Assistant Labour
Commissioner, Jeypore in P.G. Case No.1 of 2012 is appealable one. Instead of filing appeal, the petitioner has approached this Court by filing this
writ petition, which is not maintainable.
In course of hearing, learned counsel for the petitioner stated that the petitioner may be permitted to approach the appellate authority against the order
impugned.
In view of the above, the writ petition is disposed of granting liberty to the petitioner to approach the appropriate forum.
Issue urgent certified copy as per rules.
