At the outset, learned Counsel for the Judgement Debtor has submitted that a stay has been granted in Section 37 petition vide order dated 18.07.2022. Learned Counsel further submits that the decretal amount has already been deposited in Section 37 petition.

Learned Counsel for the Decree Holder has disputed the said fact. She states that there is no stay granted in Section 37 petition.

In view of Order dated 07.01.2026 passed by this Court, it is apparent that stay has been granted by the Division Bench.

Upon further perusal of the record, it is also found that there is no stamp duty deposited on the award.

Accordingly, prima facie this petition is not maintainable on the ground that there is no valid document for the purpose of enforcement.

Additionally, in view of the stay already operating in the Section 37 petition, there is no purpose to keep this enforcement petition pending before this Court.

Accordingly, the petition is disposed of with liberty to the Decree Holder to file again as and when situation arises.

The petition is disposed of in the aforesaid terms. Pending application(s), if any, also stand disposed of.
