Judgment
The instant application is filed under Section 95 of the Code seeking initiation of CIRP against the personal guarantor of the Corporate Debtor.
Learned Counsel for the Applicant states that present application is filed by the Financial Creditor i.e., Toyota Financial Services India Ltd., wherein recommendation of the name of the RP has not been given. Hence, we appoint Mr. Ishwar Lal Kalantri, having Reg. No. IBBI/IPA-001/IP-P01448/2018-2019/12439 to act as RP, no disciplinary proceeding pending against the said RP before IBBI.
The interim moratorium shall commence under Section 96 of IBC, 2016 from the date of application. The RP is directed to file report within 10 days.
We direct the Applicant as well as Registry to issue notice to the Respondent. The matter to appear on 17.03.2022.
