Judgment
The instant application is filed under Section 95 of the Code seeking initiation of CIRP against the personal guarantor of the Corporate Debtor, namely, Mr. Jaideep Avtar Singh.
Learned Counsel for the Applicant States that present application is filed through RP and declaration as mentioned in Section 97 of the Code with respect to no disciplinary proceedings being pending against the RP is also obtained.
The Interim moratorium shall commence under Section 96 of IBC, 2016 from the date of application. The RP, as suggested by the Applicant, Mr. Jayesh Natvarlal Sanghrajka having Registration No. IBBI/IPA-001/IP-P00216/2017-2018/10416 is directed to file report within ten days.
We direct the Applicant as well as Registry to issue notice to the Respondent. The matter to appear on 17.03.2022.
