Judgment
Ahanthem Bimol Singh, J
Heard Mr. M. Hemchandra, learned senior counsel assisted by Md. Juno Rahaman, learned counsel appearing for the petitioner and Mr. Th. Vashum, learned GA appearing for the respondents.
Issue notice, returnable within two weeks.
Mr. Th. Vashum, learned GA accepts notice on behalf of the respondent Nos. 1, 2 & 3, hence, no formal notice is called for in respect of the said respondents.
Petitioner is to take steps for service of notice upon the respondent Nos. 4 & 5 by way of speed post service as well as dasti service. Steps should be taken within one week. Petitioner is to file affidavit showing proof of service of such notice.
Mr. M. Hemchandra, learned senior counsel appearing for the petitioner submitted that the present writ petition can be disposed of by issuing a simple direction to the Deputy Commissioner, Chandel to consider the statutory appeal dated 18-06-2024 submitted by petitioner and to dispose of the same as provided under the relevant act and rules.
Mr. Th. Vashum, learned GA appearing for the respondents submitted that as the appeal has been recently submitted by the petitioner, he may be given a chance to get instruction from the Deputy Commissioner, Chandel as to what action has been taken with regard to the said appeal.
As prayed for by the learned GA, list this case again on 29-07-2024.
