ORDER
Company Appeal (AT) (CH) (INS) No. 150 / 2022 :
Ms. Pavithra Sundararajan, Learned Counsel appearing for the Counsel on Record Mr. K. Moorthy for the Appellant / Liquidator, informs this `Tribunal’ that the `Appellant / Liquidator’, had disbursed the entire amount, which is due and payable to the `Respondent’, as per Section 53 of the I & B Code, 2016. Therefore, the subject matter of the dispute in MA/747/2019 in TCP/413/IB/2017, has been resolved and consequently, the instant `Appeal’, has become an `Infructuous’ one.
The Learned Counsel for the Appellant submits in view of the fact that the Appellant / Liquidator, had disbursed the entire due amount, payable to the Respondent, as per Section 53 of the I & B Code, 2016, the instant `Company Appeal’, has become an `Infructuous’ one. Hence, this `Tribunal’, grants permission to the `Appellant’, to withdraw the instant `Company Appeal’. Accordingly, the Comp. App (AT) (CH) (INS) No. 150 / 2022 is `Dismissed as Withdrawn’.
