Judgment
In term of the order dated 18.10.2022 the Ld. Counsel for the Appellant has filed the up-to-date order sheet passed by the Tribunal in the matter wherein last order dated 09.11.2022 passed in CP/13(KB)2022, IA (Companies Act)/110(KB)2022, IA (Companies Act)/50(KB)2022, IA (Companies Act)/85 (KB)2022, IA (Companies Act)/14(KB)2022 reveals that the Tribunal passed the following order:
“1. Due to paucity of time the matter could not be taken up for hearing today.
Post this matter on 09.01.2023.”
Heard the Ld. Counsel for the Appellant and Respondent.
After hearing Learned Counsel for the parties and without going into the merits of this case, we dispose of the instant Appeal with the request to the Ld. National Company Law Tribunal (Kolkata Bench, Kolkata) to take up the I.As pending before them on fixed date and after hearing the parties pass appropriate orders. The parties are at also liberty to raise all the issues before the Tribunal.
With these observations, the instant Appeal is disposed off.
