This Criminal Petition under Section 439 of the Code of Criminal Procedure, 1973, is filed to enlarge the petitioner on bail.
The petitioner is A-3 in Crime No.289 of 2021 of Kodur Police Station, YSR Kadapa District.
A case under Sections 307, 353, 379 r/w 34 IPC and under Sections 20(1)(c)(ii), (iii), (iv), & (x), 36(a) r/w 32A of the A.P. Forest Amendment Act, 2016, was registered against him along with other accused in the above crime.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner was arrested in connection with the above crime on 02.03.2022 and since then he has been in judicial custody. A-1 and A-2 were already enlarged on bail. Therefore, the petitioner, who is A-3 who is similarly placed, is also entitled to bail.
Resultantly, this Criminal Petition is allowed. The petitioner is ordered to be released on bail on execution of self bond for Rs.1,00,000/-(Rupees one lakh only) with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Kodur. On his release, the petitioner shall report before the Station House Officer of Kodur Police Station, once in a week on every Sunday between 10.00 A.M and 05.00 P.M., till the charge sheet is filed in this case.
