CA No. 990/ND/2020: Application is filed by IRP seeking withdrawal of the present application filed under Section 9 of the Code. Learned counsel states that CIRP order was passed on 21st January 2020. Parties have executed settlement agreement as annexed with the application. Learned counsel for IRP further makes a statement that IRP has not received any claim and CoC is not constituted. Application allowed thereby IB-1427/ND/2019 is allowed to be withdrawn. The present IRP is discharged as IRP of Kayo Enterprises Pvt. Ltd. The assets/documents received by IRP be handed over to the management. Learned counsel for IRP states that there is no dues for expenses/fees pending. Application is allowed and disposed of in terms of above order.
