CA No. 1805/ND/2020 application filed by IRP for withdrawal of the CIRP. IRP Mr. Harish Taneja present in person and states that the parties amicably settled the matter, post initiation of the CIRP vide order dated 21.01.2020, COC in first meeting held on 20.02.2020, considered the proposal placed before it for approval to allow the parties to apply for withdrawal. COC at agenda item No. 7 approved for withdrawal. Copy of minutes of CoC Meeting with Form ‘FA’ is also placed on record. Learned counsel for the IRP makes submission that he has received the amount for the expenses and fees and nothing is due with respect to the CIRP. Application is allowed, IRP is discharged from duties to conduct CIRP of M/s DSR India Infracon Private Limited. The IRP is further directed to hand over the proceeds, records and assets of the Corporate Debtor, if received, within three days. Application is allowed, thereby IB-1763/ND/2018 stands withdrawn and disposed of.
