Mr. A. Allam, learned Counsel appearing for the Appellants submitted that the selected candidate Manish Kumar was at serial No. 502 in the merit list and the writ Petitioner was at serial No. 607 and all the candidates in between acquired 19 marks, and therefore, Manish Kumar being the senior most was appointed. The writ Petitioner cannot be appointed as the vacancies have merged in the advertisement No. 1/2010 the processes of which has already been completed. He further submitted that such facts were stated in the review petition, but it was dismissed without assigning any reason. He lastly submitted that contempt case has been filed by the writ Petitioner.

Issue notice to Respondent as to why relief sought for be not granted at the admission stage itself. Issue notice in stay matter also.

Notice in appeal as well as stay petition both may be sent in common cover by speed post with A/D for which requisites must be filed within one week, failing which this appeal shall stand dismissed without further reference to a Bench.

Till further orders, contempt proceedings, will remain stayed.
