Judgment
This appeal is filed by the Appellant/Complainant against the Judgment passed by the Special Judge for SPE & ACB CASES dated 04.04.2008 in C.C.N.07 of 2005, assailing the acquittal of the Respodents/Accused under Sections 7, 13(2) read with 13(1)(d) and 12, 13(2) read with 13(1)(d) and under Section 13(1)(d) read with 13(2) of Prevention of Corruption Act, 1988.
Learned counsel for the Appellant/Complainant submitted that recently they came to know that Respondent No.1/Accused No.1 died on 20.02.2016, and Respondent No.2/Accused No.2 died on 18.06.2011. A memo to that effect, along with the death certificates of both the accused, has also been filed. Thus, the Appeal to be disposed as abated in terms of Section 394 of CrPC.
Thus, recording the submission of the learned counsel for the Appellant, the Appeal is dismissed as abated.
As a sequel, all pending miscellaneous petitions, if any, shall stand closed.
