The present Writ petition has been filed for following reliefs:

“To quash the order dt. 30.06.2014 passed by the respondent no-2-Additional District Collector-cum-Appellate Authority in appeal no-16/2012-13 to the extent the petitioners are aggrieved whereby and whereunder the respondent no-2 without appreciating the factual, technical and legal aspect of the matter and the assessment of energy charge in case of theft of electricity in accordance with annexure-7 of Bihar Electricity Supply Code, 2007 has interfered with the final assessment order dt. 27.11.2012 passed by the petitioner no-3 to the extent that the 'D' factor of assessment has been directed to be calculated for 33 days starting from 04.08.2012 to 06.09.2012 instead of 365 days; and further to grant any other relief or reliefs for which the petitioners may be found entitled to in the law.”

At the outset, the Learned counsel for

the petitioners submitted that the instant matter is squarely covered by the order dated 24.11.2025 passed by a Co-ordinate Bench of this Court in CWJC No. 10673 of 2015 (The South Bihar Power Distribution Company Ltd. & Anr. v. State of Bihar and Ors.) along with CWJC No. 4260 of 2016 (M/s Shree Shree Dwarikaji Foods Pvt. Ltd. v. Bihar State Power Holding Co. Ltd. and Ors.).

In view of the aforesaid facts, without going into the merits of the present case, this Writ petition is disposed of in terms of the aforesaid order passed in CWJC No. 10673 of 2015 along with CWJC No. 4260 of 2016 (supra), with a direction to the petitioner to file a separate petition before the Special Court, where the criminal proceeding is pending, challenging the impugned order dated 16.03.2015 passed by the Additional Collector, Patna-cum-Appellate Authority, within a period of 30 days. The Special Court shall, after providing a fair opportunity of hearing to the petitioner, dispose of the same in accordance with law by passing a reasoned and speaking order.

With the aforesaid observations, the Writ petition stands disposed of.
