Judgment

1 Heard Mr.N.K.Majmudar, learned advocate for the petitioners and Mr.Kaushal Pandya, learned advocate for the respondents.
2 The only prayer in the petition is to decide the representation dated 09.08.2021, inasmuch as, the petitioners who are hawkers were carrying on business of sale of eatables through lorries at a place adjacent to the compound wall of Gandhi College, Majura, Surat.
2.1 Pending the petition, it appears that the Corporation confiscated their lorries and now by an order of 23.11.2021, they are willing to return the same, subject to the petitioners following certain formalities as enlisted in the order.
2.2 In the order dated 29.11.2021, the representation of the petitioners have been rejected on the ground that it is not possible for the Corporation to accede to the request of the petitioners to allow the petitioners to carry on the business at the same place as it obstructs the traffic and the foot paths which are used by the pedestrians.
2.3 However, by a communication of 23.11.2021, the Corporation has shown its willingness to return the lorries in question on the petitioner following the formalities including giving an undertaking as desired.
3 In view of the position that the representation has been rejected by a speaking order dated 29.11.2021, no useful purpose will be served in entertaining this petition which was only for a direction to decide the representation.
4 On the petitioners giving the usual undertaking and complying with the communication of 23.11.2021, the Corporation shall return the lorries to the petitioners.
With the aforesaid observation, this petition along with the civil application is disposed of.
It is clarified that the Court has not examined the legality of the order dated 29.11.2021.
