Judgment
S. Siri Jagan, J.—In respect of a dispute raised on the issue regarding regularisation of the Petitioner''s services, the Government, by Ext.P1 informed the Petitioner that the dispute has been referred for adjudication to the Kollam Labour Court, on 11.1.2007. The Petitioner submits that on enquiry with the Labour Court, the Petitioner has been informed that the Labour Court has not received the reference order.
The Petitioner, therefore, seeks the following reliefs:
a. To issue a writ in the nature of mandamus or any other appropriate writ or order directing the Respondents to take action pursuant to Exhibit P2 communication at any rate within a period of three weeks.
b. To issue a writ in the nature of mandamus or any other appropriate writ or order directing the Disposal of Exhibit P4 representation.
On 6.4.2011, I passed the following order:
In Ext.P1, the Labour Commissioner has informed the Petitioner that the dispute raised by the Petitioner has been referred for adjudication to the Kollam Labour Court on 11.1.2007. According to the Petitioner, on enquiry with the Labour Court, no such dispute has reached the Labour Court. The Govt. Pleader shall get instructions as to the present status of the dispute mentioned in Ext.P1. Post immediately after vacation.
Despite two adjournments, the Government Pleader is unable to get instructions.
In the facts and circumstances of the case, I dispose of this writ petition with a direction to the 1st Respondent to see that the reference order in respect of the dispute raised by the Petitioner reaches the Labour Court, Kollam, within one month from the date of receipt of a certified copy of this judgment, if it has not already been received by the Labour Court.
