The grievance of the petitioners in the instant Writ Petition is that though they had raised an industrial dispute before the conciliation officer under the Industrial Dispute Act and the conciliation officer also making a report that the conciliation proceedings having failed and has made an endorsement in this regard to the Labour Commissioner, but the Commissioner in turn has till date not made a reference to the Labour Court for adjudication of the disputed question.

The limited prayer which the petitioners have made in the present Writ Petition is for issuance of direction to the Labour Commissioner of the State to take a decision on the order made by the Labour officer dated 24/08/2004.

Considering the nature of dispute raised by the petitioners so also considering the fact that the conciliation officer has made a specific report that the conciliation proceedings having failed and the said report having being sent to the Labour Commissioner, let the Labour Commissioner of State take a decision on the order made by the Labour officer dated 24/08/2004 and if required an appropriate reference, if it has till date not been made be made to the concerned Labour Court for speedy redressal of the grievance of the petitioners.

Let this exercise be done by the Labour Commissioner within a period of 90 days from today.

With the aforesaid observation, the Writ Petition stands disposed off.
