Judgment
Heard learned counsel for the petitioner and Mr. N. Nagendra Babu, learned counsel for respondent No.5.
Petitioner is A1 in CC.No.3169 of 2025 pending trial in the Court of I Additional Junior Civil Judge cum XII Additional Metropolitan Magistrate, Medchal, Malkajgiri District at Kukatpally, Cyberabad. The petitioner is presently residing in USA.
Learned counsel for the petitioner submitted that Look Out Circular has been issued against the petitioner in connection with Cr.No.419 of 2025 of Kukatpally Police Station, alleging that petitioner has absconded. Subsequently, investigation was completed and charge sheet has been filed. The trial Court took cognizance of the charge and registered the same as CC.No.3169 of 2025.
Learned counsel for the respondent No.5 submitted that if the petitioner intends to come to India and travel back to USA or any other country, he is required to take permission from the trial Court. As and when permission is granted, automatically, the LOC opened against the petitioner would be suspended.
In the light of the above submissions, taking note of the fact that the petitioner is a resident of USA and facing prosecution in CC.No.3169 of 2025, this Court is not inclined to pass any orders.
However, the writ petition is disposed of giving liberty to the petitioner to file an appropriate application before the trial Court for suspension of LOC in case petitioner intends to visit India and travel back to USA. As and when such application is filed, the trial Court shall pass orders in accordance with law. In case, relief is granted to the petitioner, the LOC opened against the petitioner shall be suspended by the trial Court for the corresponding period.
The miscellaneous applications, pending if any, shall stand closed. There shall be no order as costs.
