Judgment
LEARNED counsel for petitioner states that Petitioner Company is ready to settle the matter for a total sum of Rs.1,30,000/ - (Rupees One Lac Thirty Thousand only) which amount is lying deposited with this Commission in terms of order dated 21.9.2010 passed by this Commission. There is also no objection if the aforesaid amount alongwith interest accrued, if any, be paid to Respondent No.1/Complainant.
ON the other hand, Respondent no.1 states that he is willing to settle the matter for a total sum of Rs.2,25,000/ - (Rupees Two Lac Twenty Five Thousand only).
PRESENT litigation is pending since 2004, that is, more than 11 years have lapsed. In order to put quietus to this long drawn litigation, it would be appropriate if petitioner agrees to the aforesaid proposal made by respondent no.1. Learned counsel for petitioner on instructions states that keeping in view the aforesaid observation made by this Commission, petitioner is ready to settle the matter for a total sum of Rs.2,25,000/ -.
ACCORDINGLY , the present matter stand amicably settled. In pursuance of the aforesaid settlement, the petitioner shall remit a sum of Rs.2,25,000/ - (Rupees Two Lac Twenty Five Thousand only) to respondent no.1/complainant, within six weeks, by way of demand draft directly in his name. Meanwhile, the amount lying deposited with this Commission shall be released to the petitioner company alongwith accrued interest, if any. With these observations, the present petition stand disposed of.
