The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 06.01.2018 whereby Education Tribunal, Chandigarh dismissed her appeal against order dated 28.07.2012.
The petitioner was appointed as Principal of Banyan Tree School, Sector 48-B, Chandigarh. She was terminated vide communication dated 28.07.2012. She filed appeal before Education Tribunal, Chandigarh. The matter came up for consideration before Additional District Judge, Chandigarh who vide order dated 06.01.2018 dismissed her appeal.
On being asked, learned counsel for the petitioner confirmed that petitioner has turned 64 years and her contractual period in any case has passed away.
The petitioner was appointed for a period of five years, however, she was terminated after 01 year and 07 months. She had already attained age of 64 years. The contractual period in any case expired in 2016. In these circumstances, this Court is of the considered opinion that, at this stage, no substantive relief can be granted and adjudication of issue on merits would be academic exercise.
