With consent of the learned counsels for the parties, the present petition is taken up for final disposal.
The petitioners had participated in the selection process for the post of Constable (GD) in Central Armed Police Force (CAPF), NIA & SSF and Rifleman (GD) in Assam Rifles. The petitioners were declared successful, however the appointment orders could not be issued in their favour for want of their biometric verification. This prompted the petitioners to approach this Court for directing the respondents to complete the selection process/biometric verification of the petitioners expeditiously.
Response stands filed by the respondents. In nutshell, stand of the respondents is that in order to examine the genuineness of the candidature by process of biometric verification, some time is required for the formal declaration of the result and issuance of the appointment orders in favour of the selected candidates.
In an identical case, the High Court of Kerala in case titled, ‘Udayakumar K. vs. Union of India’ had permitted the respondents therein to expedite the Forensic Examination and to address the laboratory to send the Forensic Reports at the earliest. Pending such exercise, the respondents have been directed to initiate process for issuance of the appointment orders to each of the candidates, subject to furnishing of notarized affidavits.
In view of the above, this Court deems it proper to dispose of the present writ petition by directing the petitioners to furnish an undertaking to be sworn before the Judicial Magistrate First Class with photograph, thumb impression and Aadhar number, stating therein that in the event any impersonation is found, his/her candidature shall stand rejected. After the petitioners submit the undertakings with the respondents, the respondents shall proceed to issue the appointment orders in favour of the petitioners in accordance with law.
