The present petition has been filed by the petitioner for seeking direction to the respondents to consider the claim of the petitioner and to promote him as Store Keeper with effect from 2013 and Marketing Officer with effect from 2020 in the J&K Handloom Development Corporation Ltd. on the ground of parity, as the other employees junior to the petitioner were given promotion over and above the petitioner.
Response stands filed by the respondents, wherein the respondents have admitted the claim of the petitioner, thereby stating that the case of the petitioner was examined and it was found that the grievances of the petitioner were genuine, as the persons junior to the petitioner, namely, Darshan Kumar and Anita Devi had been promoted over and above the petitioner. Therefore, after consideration of the grievances of the petitioner it has been found that the petitioner is senior and needs to be promoted/elevated in terms of Article 72 (B) and accordingly the case of the petitioner has been referred to the Departmental Promotion Committee.
In view of the categoric admission made by the respondents that the petitioner is senior and needs to be promoted/elevated and his case has been referred to the Departmental Promotion Committee, the present petition is disposed of by directing the respondents to take appropriate decision in view of the admission made by them within a period of two months from today.
In the event the grievances of the petitioner still remain unaddressed, he shall be at liberty to approach this Court afresh.
