P.P. Bhatt, J.—Present application is filed by the applicants - convicts seeking Temporary Bail for a period of 30 days on the ground of marriage of nephew, which is scheduled on 17th & 18th May 2011. In support of the application, a zerox copy of Invitation Card is produced. The learned advocate for the applicants - convicts submitted that the applicants being maternal uncles, their presence is necessary on this occasion.

Rule. Learned Additional Public Prosecutor Mr. Dabhi waives service of process of Rule.

Learned Additional Public Prosecutor made available for perusal the Jail Remarks. On perusal of the same, it appears that the applicants have, by now, undergone imprisonment of 02 years, 10 months and 25 days. It also appears that both the applicants have enjoyed two Furloughs, one in the year 2009 and another in the year 2011 and every time, they reported in jail in time. Nothing adverse is noticed against the convicts in the Jail Remarks.

Taking into consideration the contents of the application, the application is allowed. The applicants -convicts are ordered to be released on Temporary Bail for a period of 10 days from the date of their release, on their executing a personal bond of Rs. 5,000/-(Rupees Five Thousand only) each to the satisfaction of the jail authorities.

4.1. The convicts shall surrender to the jail authorities on expiry of the Temporary Bail period.

4.2. Rule is made absolute to the aforesaid extent. Direct service is permitted today.
