Heard Smt.S.V.Indira, learned counsel for the petitioner, Smt.Ch.Swapna Priya, learned Assistant Government Pleader for Social Welfare for respondents 1, 3, 5 & 6 and Sri Bharat Singh, learned Assistant Government Pleader for Revenue for respondents 4 and 7.
The above Writ Petition is filed impugning the action of 5th respondent in not disposing of LTRP No.29 of 2021 on the file of Special Deputy Collector, Tribal Welfare, Rampachodavaram, Alluri Seetharamaraju District, in pursuance of remand, by order dated 24.01.2023 in C.M.A.No.18 of 2022 on the file of the Additional Agent to Government, Rampachodavaram, Alluri Seetharamaraju District, as illegal and arbitrary.
The petitioner filed LTRP No.29 of 2021 against K.Subbaraju and others and the same was disposed of on 21.04.2022. Aggrieved by the same, the petitioner filed C.M.A.No.18 of 2022 on the file of the Additional Agent to Government, Rampachodavaram, Alluri Seetharamaraju District under Rule 8 (2) of the Andhra Pradesh Scheduled Areas Land Transfer Rules, 1969. The appellate authority by order dated 24.01.2023 remanded the matter to the Special Deputy Collector, Tribal Welfare, Rampachodavaram to re-examine the issue in the light of the observations made therein. However, the learned Special Deputy Collector, Tribal Welfare, Rampachodavaram has not disposed of LTRP No.29 of 2021.
Learned Assistant Government Pleader for Social Welfare, on instructions, would submit that the Special Deputy Collector, Tribal Welfare, Rampachodavaram will dispose of LTRP No.29 of 2021 and in fact the authority posted the case for hearing on 27.03.2025.
Given the facts and circumstances of the case, the Writ Petition is disposed of, at the admission stage, with the consent of both the counsel, directing the learned Special Deputy Collector, Tribal Welfare, Rampachodavaram to dispose of the LTRP No.29 of 2021 as expeditiously as possible preferably within a period of three months from the date of this order, strictly as per the Rules. No costs.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
