Judgment
The present writ petition has been filed by the petitioner challenging the order dated 28/09/2026, whereby the respondent No.2 has cancelled the attachment order 30/05/2025.
Learned counsel for the petitioner submits that, vide order dated 30.05.2025, the petitioner was attached to Zila Panchayat, Gariyaband, from Zila Panchayat, Narayanpur, at his own request, on the ground of ill health of his parents. However, the said order has subsequently been cancelled. It is further submitted that if the petitioner is relieved from his present place of posting, he would suffer irreparable hardship, as he would be unable to take proper care of his ailing parents. Learned counsel further submits that the petitioner has already submitted a representation before respondent No. 2 and, therefore, the writ petition may be disposed of with a direction to respondent No. 2 to consider and decide the said representation, taking into account the grievance raised by the petitioner.
Learned counsel appearing for respondent No. 2/Director submits that, since the petitioner has already submitted a representation before respondent No. 2, the same shall be considered and an appropriate order will be passed in accordance with law, within a period of thirty days, taking into consideration the grievance raised by the petitioner, particularly the fact that his old and ailing parents are residing with him.
I have heard learned counsel for the parties and perused the documents appended with the writ petition.
Having considered the submissions made by learned counsel for the parties and without expressing any opinion on the merits of the case, this writ petition is disposed of with a direction to respondent No. 2 to consider and decide the representation submitted by the petitioner, in accordance with law, by taking into consideration the grievance raised by the petitioner, particularly the fact that his old and ailing parents are residing with him, and to pass an appropriate reasoned order within a period of thirty days from the date of receipt of a copy of this order.
Accordingly, the present writ petition is disposed.
