Judgment
Accused nos.4 and 5 in Crime No.68 of 2026 registered by Masti Police Station, Kolar District for offences punishable under Sections 103(1) & 55 r/w 3(5) of BNS, 2023 are before this Court in these two petitions filed under Section 483 of BNSS, 2023 seeking regular bail.
Heard the learned counsel for the parties.
FIR in Crime No.68 of 2026 was registered by Masthi Police Station, Kolar District for the aforesaid offences against one Darshan and others, based on the first information dated 09.05.2026 received from Sri Manjunatha S. In the said case, petitioners were arrested on 13.05.2026 and remanded to judicial custody. Their bail application filed before the jurisdictional Sessions court in Crl.Misc.No.416 of 2026 and Crl.Misc.No.421 of 2026 was rejected as against them. Therefore, they are before this Court.
Perusal of the material on record would go to show that, petitioners' name is not found in the FIR which is registered against Darshan and others. During the course of investigation, petitioners who are friends of accused nos.1 and 2 were arrested and remanded to judicial custody. The material on record would go to show that, accused nos.1 and 2 are the assailants in the present case. Accused no.3 is the father of accused no.1 and he allegedly was the instigator in the present case. Accused nos.6 and 7 are also said to be the conspirators along with the petitioners herein. Accused no.3, accused no.6 and accused no.7 have been granted regular bail in the present case by the jurisdictional Sessions Court.
The submission made by learned counsel for the petitioners that the petitioners do not have any criminal antecedents is not seriously disputed by the learned HCGP. Under the circumstances, the following :-
ORDER
Criminal petition is allowed.
The petitioners are directed to be enlarged on bail in Crime No.68 of 2026 registered by Masti Police Station, Kolar District for offences punishable under Sections 103(1) & 55 r/w 3(5) of BNS, 2023, subject to the following conditions:
Petitioners shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons;
The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses;
The petitioners shall not involve in similar offences in future:
The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
